Can You Own A Gun If Your Felony Is Expunged?

Minnesota Criminal Defense Attorney Lynne Torgerson obtained a gross misdemeanor in a felony charge of felon in possession of a firearm out of the County of Olmsted, State of Minnesota.  Defendant was a 40 year old white male.  He was married, with children.  He was gainfully employed.  He had previously been convicted of a felony crime of violence, whereby he was prohibited from possessing a firearm for life.  He was charged with ineligible person in possession of a firearm after attempting to purchase a firearm at a local Scheel’s store.  Ultimately, the case was resolved with the defendant pleading guilty to the charge; however, the judge sentenced it as a gross misdemeanor, no jail time, and two (2) years probation, out of Olmsted County, Minnesota.  The City of Rochester is the major city in this county, in southern Minnesota.  This resolution avoids having a felony go on the defendant’s record.  Well done Ms. Torgerson.
