CASE LAW UPDATE: Whether possession of marijuana and firearms may get you a federal prison sentence?
Where a defendant challenged his convictions and sentence after being convicted of being an unlawful user of a controlled substances, the District Court rejected the argument that a showing of “regular drug use” requires evidence of use over an extended period, and evidence that the defendant was actively engaged in the use of marijuana while he possessed firearms satisfied the temporal nexus between gun possession and regular drug use and was sufficient to support the conviction. Affirmed.
